This website is operated by Grovity Pty Ltd. Throughout the site, the terms "we", "us" and "our" refer to Grovity Pty Ltd.
By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms of Service ("Terms"), including any policies referenced herein (such as our Privacy Policy and Shipping/Refund policies where applicable).
If you do not agree to these Terms, you must not access or use the website.
Our store is hosted on Shopify Inc., which provides the online e-commerce platform that enables us to sell our products to you securely. You may also be subject to Shopify's terms where applicable, but these Terms govern your relationship with us.
These Terms are governed by and must be interpreted in accordance with the Australian Consumer Law (ACL) and other applicable Australian laws. Nothing in these Terms is intended to exclude, restrict or modify any non-excludable rights or remedies you have under the ACL or any other law.
1. Online Store Terms
You must be at least 18 years of age (or the age of majority in your jurisdiction) to purchase products from this website.
You agree not to use our products or the website for any unlawful purpose or in violation of any applicable laws (including resale in breach of any restrictions).
We reserve the right to refuse service to anyone for any reason at any time, provided such refusal complies with the ACL and does not constitute misleading or deceptive conduct.
You agree not to misuse the website (e.g. by hacking, introducing viruses, or engaging in fraudulent activity).
2. Product Information and Cosmetic Use
Grovity Hair Gro Serum is a cosmetic product only. It is not intended to diagnose, treat, cure or prevent any medical condition or disease.
Results vary between individuals and are not guaranteed.
By purchasing and using our products, you acknowledge and agree that:
- You have reviewed the full ingredient list;
- You are responsible for checking for allergies or sensitivities;
- You will conduct a patch test prior to full application; and
- You use the product at your own risk and in accordance with the instructions.
We are not liable for allergic reactions, irritation, misuse, or failure to follow instructions, except to the extent required by the ACL (e.g. where the product fails to be of acceptable quality or match its description).
3. Australian Consumer Law and Consumer Guarantees
Nothing in these Terms excludes, restricts or modifies any of your rights or remedies under the Australian Consumer Law (ACL) (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law.
Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Key Consumer Guarantees
Key consumer guarantees that apply to our products include (but are not limited to):
- Goods are of acceptable quality (safe, durable, free from defects, acceptable appearance and finish, and fit for all purposes for which goods of that kind are commonly supplied);
- Goods are fit for any particular purpose disclosed by you or made known to us (or for which we represent they are fit);
- Goods match their description, any sample or demonstration model;
- We have clear title to the goods and you will have undisturbed possession; and
- Any express warranties we give are honoured.
Your Rights Under Consumer Guarantees
If a product fails a consumer guarantee:
- For a major failure, you may choose a refund, replacement or (in some cases) compensation; OR
- For a minor failure, we will generally repair or replace the product (or offer a refund where reasonable).
These rights exist in addition to any voluntary policies we offer. We will not make any representations that contradict or limit your ACL rights (e.g. we will never state that "no refunds apply to opened products" where an ACL remedy is available).
Where the ACL permits us to limit our liability, our liability is limited to (at our option):
- Replacement of the product; OR
- Refund of the purchase price.
4. 30 Day Money-Back Guarantee (Voluntary Policy)
In addition to (and without limiting) your rights under the ACL, we offer a voluntary 30-Day Money-Back Guarantee subject to the following conditions:
- The product must be returned (including the bottle, even if partially used) within 30 days of delivery;
- You are responsible for return postage and any risk of loss during return;
- A $10 delivery and handling fee will be deducted from the refund;
- The refund applies to the product price only (not shipping or any other fees); and
- Free gifts or promotional items must also be returned. If not returned, their full retail value will be deducted.
We reserve the right to refuse refunds under this voluntary policy where abuse, excessive returns or fraud is suspected.
This voluntary policy does not limit or replace your rights under the ACL.
5. Pricing and Payment
All prices are in Australian Dollars (AUD) and include GST unless otherwise stated.
We endeavour to ensure prices and descriptions are accurate, but errors may occur. We reserve the right to correct any pricing or description errors and to cancel or refuse any order placed at an incorrect price. If we cancel, we will notify you and provide a full refund.
Payments are processed securely through our Shopify platform. You authorise us (or our payment processor) to charge your chosen payment method for the full amount including any applicable shipping and taxes.
6. Orders, Cancellations and Amendments
Placing an order constitutes an offer to purchase. A binding contract is formed only when we accept the order (typically by sending an order confirmation email or dispatching the goods).
Orders may only be amended or cancelled within 30 minutes of placement during business hours (subject to stock availability and our acceptance).
During promotional or sale periods, or once dispatched, orders generally cannot be amended or cancelled (except where required by the ACL).
We reserve the right to cancel or refuse orders suspected of fraud, bulk reselling, misuse of discount codes, or where we reasonably believe the order breaches these Terms.
7. Discounts, Promotions, Bundles and Subscriber Offers
Only one discount code may be used per order unless otherwise stated. Discount codes are not transferable, cannot be redeemed for cash, and cannot be applied retrospectively.
If an order involving a bundle or promotional discount is partially returned (under the voluntary policy), the discount may be recalculated based on full retail pricing of retained items.
We reserve the right to cancel orders or revoke discounts where they have been misused or exploited.
Subscriber Offers
From time to time, Grovity may offer a discount (including but not limited to 10% off) to customers who subscribe to our email newsletter or marketing communications.
Subscriber discounts:
- Apply to purchases made directly through www.grovity.com.au only;
- May be limited to first-time purchases only;
- Are valid for a limited time unless otherwise stated;
- Cannot be combined with other discount codes, bundles, or promotional offers unless expressly stated; and
- Cannot be applied retrospectively to completed orders.
We reserve the right to modify or withdraw subscriber offers at any time.
Marketing Communications
By subscribing to our newsletter or accepting a subscriber discount, you agree to receive marketing communications from Grovity Pty Ltd via email.
If you provide your mobile number and opt in, you may also receive SMS marketing communications.
You may unsubscribe at any time using the unsubscribe link provided in our communications or by contacting us at info@grovity.com.au.
8. Shipping, Delivery and Risk
Delivery timeframes are estimates only and not guaranteed (subject to stock, carrier delays and the ACL).
Authority to Leave
If you select "Authority to Leave" (or equivalent), you accept full responsibility for any loss, theft or damage after the carrier leaves the parcel at the nominated address. We are not liable for stolen or missing parcels in such cases.
Incorrect Addresses
If an incorrect or incomplete address is provided and the parcel is returned to us, you may be responsible for additional shipping fees to re-send.
International Orders
International customers are responsible for all customs duties, taxes, import fees, and any other charges. We are not liable for delays or costs at customs. Risk in the goods passes to you upon dispatch to the carrier (or earlier if Authority to Leave applies).
Title in the goods passes to you upon full payment.
9. Changes to These Terms
We may update or amend these Terms from time to time by posting the revised version on the website with a new effective date.
Changes do not apply retrospectively to orders already accepted by us. Your continued use of the website after any changes constitutes acceptance of the updated Terms.
10. Limitation of Liability
Subject to the ACL and to the maximum extent permitted by law, Grovity Pty Ltd, its directors, employees, contractors and affiliates shall not be liable for any:
- Indirect, consequential or incidental loss;
- Loss of profits, revenue, data or goodwill;
- Business interruption; OR
- Special or punitive damages.
Our total aggregate liability to you shall not exceed the purchase price of the relevant product(s).
This limitation does not apply to liability that cannot be excluded under the ACL (including for personal injury or death caused by our negligence).
11. Indemnity
You agree to indemnify and hold harmless Grovity Pty Ltd and its directors, employees, affiliates and contractors from any claims, damages, liabilities, costs or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms;
- Misuse of our products;
- Your violation of any law; OR
- Any third-party claims arising from your conduct or use of the website/products, except to the extent caused by our breach of the ACL or our negligence.
12. Privacy and Data Protection
We collect, use, store and disclose your personal information in accordance with our Privacy Policy (available on the website) and the Australian Privacy Principles under the Privacy Act 1988 (Cth). By using the website and placing orders, you consent to this collection and use.
13. Testimonials and Marketing Disclaimer
Any testimonials, before/after images, influencer content or user-generated content reflect individual experiences only. Results are not guaranteed and are for cosmetic and informational purposes only. They do not constitute medical advice.
14. Third-Party Links and Services
We are not responsible for the content, accuracy, or practices of any third-party websites, tools, or services linked from our website. Use of such third-party services is at your own risk.
15. Intellectual Property
All content on this website (including logos, branding, images, product names, text and marketing materials) is the intellectual property of Grovity Pty Ltd or its licensors.
Unauthorised reproduction, distribution, modification or commercial use is strictly prohibited.
16. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including (but not limited to) acts of God, war, strikes, pandemics, supply chain disruptions, or government restrictions.
17. Severability
If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
18. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales.
